Terms of use

These terms apply to your use of the MachinesAfrica Rentals website and to enquiries made through our contact form. By submitting an enquiry or using the site, you agree to the conditions set out below.

1. Using the MachinesAfrica Rentals website

This website is operated by Astros Marketing (Pty) Ltd on behalf of MachinesAfrica Rentals. The content is provided for general information about plant and machinery hire, depot coverage and related services in Gauteng, KwaZulu-Natal and the Western Cape. While we aim to keep information accurate and current, we do not guarantee that every product description, availability note or service detail will always be complete, current or error free.

You may use the site to review services, submit an enquiry and request follow up for hire on construction and related sites. You must not use the site in any way that interferes with its operation, attempts unauthorised access, or copies content for commercial use without written permission.

2. Enquiries, quotes and hire agreements

An enquiry sent through the contact form does not create a binding hire agreement. Any quotation, availability check or delivery estimate is subject to stock, location, site access and final confirmation from our team. A confirmed booking only arises once the order is accepted and the hire terms are issued or agreed.

Hire conditions may vary by machine type, duration, transport requirements, operator supply and the area of use. For example, a project in Germiston may be handled differently from a coastal site in Durban or a long-term package in Cape Town where salt air, wind exposure and municipal access rules can affect servicing and scheduling.

3. Hire equipment, site use and responsibility

All hired equipment remains the property of MachinesAfrica Rentals at all times. The hirer is responsible for safe handling, proper use, protection from theft or damage and daily checks where applicable. Equipment must be used only for the purpose stated at the time of hire and only by competent persons or approved operators where operator supply has been arranged.

  • Ensure the site is ready for delivery and off loading.
  • Provide safe access, suitable ground conditions and clear instructions for entry.
  • Keep equipment secure when not in use, including after hours and over weekends.
  • Report faults, loss, damage or abnormal wear as soon as they are noticed.
  • Do not move, alter or sub hire equipment without written approval.

4. Delivery, servicing and breakdown response

We offer site deliveries, same-day dispatch where possible, on-site servicing, plant swop-outs and off-hire collections across selected depots and routes. Delivery times are estimates only and may change due to traffic, weather, load-shedding, depot workload, road conditions or site restrictions. We will make reasonable efforts to assist, but we are not liable for delays beyond our control.

If equipment develops a fault, the hirer must stop using it immediately and notify us for assessment. Where a breakdown is caused by misuse, contamination, lack of fuel, poor maintenance or unauthorised repair, the hirer may be charged for recovery, transport and repair costs. This is often the case where equipment has been exposed to dust, slurry or coastal humidity and basic checks were not carried out.

5. Charges, deposits and late return

All charges are payable in Rand and may include hire fees, delivery, collection, operator supply, fuel, cleaning, consumables, damage recovery and any special service requested. We may require a deposit or advance payment before release of equipment. Final billing will follow the confirmed hire period and any additional costs incurred during the hire.

  • Hire charges continue until the equipment is returned, collected and checked in.
  • Late return may attract extra charges for the additional period.
  • If equipment is returned dirty, incomplete or damaged, cleaning and repair costs may be added.
  • Fuel management arrangements must be followed exactly as agreed.

Failure to settle amounts on time may result in suspension of further hire, collection action or referral for debt recovery. Interest and administration charges may apply where allowed by law.

6. Liability, compliance and governing law

You are responsible for obtaining any site permission, municipal approval or safety documentation required for your project. This includes compliance with site rules, traffic control, lifting plans, work at height requirements and any legal duty relating to plant operation or access. Our safety and compliance team may request documentation before or during hire.

To the fullest extent permitted by law, MachinesAfrica Rentals and Astros Marketing (Pty) Ltd will not be liable for indirect loss, loss of profit, project delay or consequential damage arising from use of the site or hired equipment, except where such liability cannot legally be excluded. These terms are governed by the laws of South Africa, and any dispute will be dealt with in the appropriate South African forum.

We may update these terms from time to time without prior notice. Continued use of the website after an update means you accept the revised terms.
